POLISH TELEVISION CONTENT PROVIDER SUES FOR INTERNET-BASED COPYRIGHT AND TRADEMARK INFRINGEMENTIn May, 2006 DLE attorneys Phillip J. Zisook, Jeffrey E. Schiller and Leon E. Farbman filed a lawsuit on behalf of Telewizja Polsat, S.A., a provider of Polish-language television, for copyright and trademark infringement. In the lawsuit, Telewizja Polsat, S.A. v. Telewizja Polsat, S.A. v. Polska Wizja LLC et al, Polsat sought relief against multiple defendants who were wrongfully disseminating Polsats’s programming on the Internet. In October, 2006, U.S. District Court Hon. Judge Ruben Castillo issued a permanent injunction order against Polska Wizja LLC and its owners, prohibiting them from further disseminating Polsat’s programming, restraining them from selling unauthorized subscriptions and ordering them to account to Polsat for all subscriptions wrongfully sold and income they received from the unauthorized sales.
