Deutsch, Levy & Engel has undertaken the representation of Telewizja Polska USA, Inc. in its federal lawsuit against Echostar Satellite Corporation. Telewizja Polska is the exclusive license holder in North America for TV Polonia - the Polish-language network operated by the Polish government. Echostar Satellite formerly carried TV Polonia on its DISH satellite television network.
In its Complaint, Telewizja Polska alleges that Echostar breached the terms of an agreement between them by continuing to sell new subscriptions to TV Polonia after its right to do so had lapsed and failing to pay Telewizja Polska its proper share of subscription revenue. Telewizja Polska also alleges that Echostar infringed on the “TV Polonia” trademark in advertising and selling new subscriptions. The case, Telewizja Polsksa USA, Inc. v. Echostar Satellite Corporation, No. 02 C 3293, is pending in the United States District Court for the Northern District of Illinois.
